3.1 We take all reasonable steps to ensure that this Website is available 24 hours every day, 365 days per year. However, websites do sometimes encounter downtime due to server and, other technical issues. Therefore we will not be liable if this website is unavailable at any time.

3.2 This Website may be temporarily unavailable due to issues such as system failure, maintenance or repair or for reasons beyond our control. Where possible we will try to give our visitors advance warning of maintenance issues but shall not be obliged to do so.

4.1 With the exception of personally identifiable information, the use of which is covered under our Privacy Policy, any material you send or post to this Website shall be considered non-proprietary and not confidential. This exclusion shall include servicing or repair costs and, without limitation, any other direct, indirect or consequential loss, and whether in tort or contract or otherwise in connection with this Website.

6.2 Nothing in these Terms shall exclude or limit liability for (i) death or personal injury caused by negligence (as defined by the Unfair Contract Terms Act 1977); (ii) fraud; (iii) misrepresentation as to a fundamental matter; or (iv) any liability which cannot be excluded or limited under the law of the United Kingdom.

This Legal Notice shall be governed by and construed in accordance with English law. Any dispute(s) arising in connection with this Legal Notice are subject to the exclusive jurisdiction of England and Wales.

8.1 Machinery parts are guaranteed against defect in material and workmanship during the period of 12 months from the date of the delivery.

8.2 Time shall not be the essence of the contract.

8.3 The supplier does not hold himself responsible for any losses consequent upon the non performance of the machinery supplied.

8.4 All goods remain the property of the supplier until paid in full by the customer.

8.5 All orders and spare parts will be dispatched via a carrier, if the customer does not wish for the goods to leave in this way the customer will be held responsible for the payment of the goods if they are lost or damaged in transport.

8.6 Butchers Equipment Warehouse reserves the right to modify prices and specifications without prior notice.

9.1 The Supplier reserves the right to change the advertised price before acceptance of an order. In such situation, Butchers Equipment Warehouse shall notify the Customer about any changes before accepting the offer.

10.1 Standard goods can be cancelled within 14 days of delivery. Customers have then 14 days from cancelation to return the item at the customers expense.

10.2 Goods being returned must be unused and in its original packaging.

10.3 The delivery costs paid on all non-fault returns or change of mind will not be refunded.

10.4 Non standard goods such as special order items or custom made items cannot be returned.

10.5 If we have sent the wrong product, which does not match the description on your invoice, you can return it to us for an exchange or refund. We will refund the cost of postage where applicable.

10.6 A refund will be honoured in full if the order is cancelled before the goods have been dispatched.

10.7 Once the goods have been dispatched the charges outlined above will incur.

11.1 All new products purchased are guaranteed against defect in material and workmanship during the period of 12 months from the date of delivery.

11.2 All new products purchased are covered by a 12 months PARTS ONLY warranty.

11.3 This warranty does not cover consumable parts, day to day wear & tear or water damage.

11.4 The Company shall be under no liability if the defect or failure, in the reasonable opinion of the Company, arises from willful damage or misuse, negligence by the customer or any third party, failure to follow the Company's instructions, or alteration or repair of the goods without the Company's prior approval

12.1 The Supplier will use its reasonable efforts to deliver the Goods promptly. However the Supplier uses independent carriers and cannot guarantee time or date of delivery. Deliveries on Saturdays or at other specific times or locations outside mainland UK are subject to extra charges. Such charges are subject to quotation.

12.2 Delivery times given are estimates only.

12.3 The Customer must examine the Goods on delivery and before the carrier leaves the Customer’s premises and if there is any damage the Customer must either refuse delivery or clearly specify damage on the delivery note.

12.4 Any damaged or missing items must be reported within 2 working days after receiving delivery.

13.1 The Supplier shall not be liable for any failure to deliver the Goods arising from circumstances outside the Supplier’s control.

13.2 Non-exhaustive illustrations of such circumstances would be act of God, war, riot, explosion, abnormal weather conditions, fire, flood, strikes, lockouts, Government action or regulations (UK or otherwise), delay by suppliers, accidents and shortage of materials, labour or manufacturing facilities.

14.1 Items on this website will not be supplied to persons under 18 years of age - in compliance with the Offensive Weapons Act 1996. To enable your order to be processed you must have read and ticked your acceptance of our terms and conditions on the checkout page and by so doing you confirm that you are over 18.
